How Mahere Capital collects, uses, shares and protects information about you and your business.
This Privacy Policy explains how Mahere Capital (“Mahere Capital,” “we,” “us” or “our”) collects, uses, shares and protects information in connection with maherecap.com, our funding application, our document upload portal and our related services (together, the “Services”).
Mahere Capital provides commercial financing to businesses. Most of the information we handle relates to a business and to the owners or officers who apply on that business’s behalf. By using the Services or submitting an application, you agree to this Policy.
1. Information we collect
Information you give us
- Business information — legal and DBA name, EIN, entity structure, industry, time in business, number of employees, address, phone, email, website, revenue and average bank balance.
- Owner and guarantor information — name, title, ownership percentage, date of birth, home address, phone and email.
- Financial documents — bank statements and other supporting documents you upload through the application or the document portal.
- Application records — your typed signature, the date signed, the authorization you accepted, and the completed application PDF generated from your entries.
- Correspondence — messages you send us by form, email, phone or text.
Information we obtain from others
- Consumer and business credit reports and related scores, obtained with your authorization from consumer reporting agencies and commercial credit bureaus.
- Bank, trade and public-record data — verification of statements with the issuing institution, trade references, business filings and similar sources.
- Referral partners and brokers — if your application reached us through a partner, we receive the information they collected from you.
Information collected automatically
When you visit the site, we and our hosting provider may log standard technical data such as IP address, browser and device type, pages viewed, referring page and timestamps. We use cookies and similar technologies for basic site functionality and, where enabled, aggregate traffic measurement. We do not use this data to build advertising profiles about you.
2. How we use information
- To evaluate, underwrite and respond to your funding application.
- To verify your identity, your business and the documents you submit, and to detect and prevent fraud.
- To obtain, present and service offers of funding, including renewals and collections.
- To communicate with you about your application and account, including by phone, text message and email where you have authorized it.
- To operate, secure, maintain and improve the Services.
- To comply with applicable law, subpoenas, regulatory requests and our own record-keeping obligations.
3. How we share information
To place your file with a funding source, we share your application and supporting documents. Specifically, we may disclose information to:
- Funding sources, lenders, banks and investors considering your application.
- Our affiliates, successors, assignees and designees, and to servicers and syndication partners, in connection with obtaining, funding, servicing, assigning or collecting on funding extended to you.
- Service providers that work on our behalf — hosting, email delivery, document storage, e-signature, CRM, analytics and similar vendors — under obligations to protect the information.
- Consumer reporting agencies and commercial bureaus, for the credit inquiries and reporting you authorized.
- Legal and regulatory recipients, where required by law, to enforce our agreements, or to protect the rights, property or safety of Mahere Capital, our customers or others.
- A successor entity, in connection with a merger, acquisition, financing or sale of all or part of our business.
We do not sell your personal information for money, and we do not share it with third parties for their own independent advertising. Because we share applications with funding partners as described above, some state privacy laws define that activity broadly as a “sale” or “sharing”; you may object or opt out by contacting us at admin@maherecap.com, though doing so will generally prevent us from obtaining an offer for you.
4. Credit authorization
When you sign our funding application, you authorize Mahere Capital and its affiliates, successors, assignees and designees to obtain business and personal consumer credit reports and other financial information about the business and each owner or guarantor, both in connection with the application and on a continuing basis to update, renew, review or collect on any funding extended. You may revoke that authorization at any time by written notice to admin@maherecap.com; revocation is not retroactive and does not affect funding already extended.
5. Calls, texts and email
By providing your phone number on the application or our contact forms, you consent to receive calls, text messages and emails from Mahere Capital and its assignees and designees about your application and your account, including messages sent using automated technology. Consent to marketing messages is not a condition of obtaining funding. Message and data rates may apply. You may opt out of texts by replying STOP, of marketing email by using the unsubscribe link, or of both by emailing admin@maherecap.com. We may still contact you about an active application or account.
6. How we protect information
Applications and uploads are transmitted over encrypted connections (HTTPS), and access to submitted files is limited to personnel and partners who need it to evaluate or service your file. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send sensitive documents to us through unsecured channels — use the application or the document portal.
7. How long we keep information
We retain applications, supporting documents and related records for as long as needed to evaluate and service your file, and thereafter as required by our legal, tax, audit and record-keeping obligations. Records associated with funding that was extended are generally kept for the life of the transaction plus the applicable statutory retention period. When information is no longer needed, we delete it or render it unreadable.
8. Your choices and rights
- Access and correction — you may request a copy of the application information we hold about you, or ask us to correct it.
- Deletion — you may request deletion of information we are not required to retain by law or for an active or completed transaction.
- Marketing opt-out — you may opt out of marketing calls, texts and email at any time, as described in Section 5.
- Credit authorization — you may revoke it prospectively, as described in Section 4.
- State privacy rights — residents of California and other states with comprehensive privacy laws may have additional rights, including the right to know what personal information we collect and disclose, to request deletion or correction, to opt out of “sale” or “sharing,” and not to be discriminated against for exercising those rights. Note that much of the information we handle about a business and its owners in a commercial credit transaction is subject to the federal Gramm-Leach-Bliley Act and may be exempt from some state privacy laws.
To exercise any of these, email admin@maherecap.com with the business name and the email address used on your application. We will verify your identity before acting and will respond within the time required by applicable law.
9. Third-party sites
Our site links to third-party sites and partners that operate under their own privacy policies. We are not responsible for their practices; review their policies before providing information to them.
10. Children
The Services are for businesses and are not directed to anyone under 18. We do not knowingly collect information from children.
11. Changes to this Policy
We may update this Policy from time to time. The effective date at the top reflects the most recent version, and material changes will be posted on this page. Continued use of the Services after an update means you accept the revised Policy.
